1. Scope of Application and Contracting Parties
- Applicability: These Terms and Conditions apply to all orders placed via our online shop.
- Contracting party: The contract of sale is concluded with: MODELLBAULAND Hauptwil, c/o D. Mouron, Weierwis 2, 9213 Hauptwil, Switzerland.
- Exclusivity: Any terms and conditions put forward by the customer shall only apply if we have confirmed them in writing in advance.
- Changes: We reserve the right to change prices and to amend the terms of delivery and payment.
2. Offer, prices and conclusion of contract
- Sales prices: All sales prices are ex Hauptwil (Switzerland), are quoted in Swiss francs (CHF) and are subject to change.
- VAT: The statutory Swiss value added tax (VAT) is included in the prices.
- Non-binding nature: Our offers, product descriptions (colour, appearance, texture) and technical specifications in the online shop are subject to change and are not binding. We reserve the right to correct any printing errors or mistakes.
- Price adjustments for reorders: Prices for items currently out of stock, which need to be reordered from the supplier or manufacturer or will only arrive at a later date, may be subject to change. This applies in particular to price changes made in the meantime by the manufacturer, as well as to changes due to exchange rates and inflation.
- Reservation: We reserve the right to make price adjustments and changes to our delivery and payment terms at any time.
- Link to stock: The online shop is linked to our physical shop stock. The stock status indicators are provided for guidance only. Due to simultaneous in-store sales, items may be temporarily unavailable or sold out. In such cases, we will inform you immediately.
- Minimum order value: The minimum order value for deliveries within Switzerland is CHF 15.00. The minimum order value for deliveries abroad is CHF 150.00.
- Conclusion of contract: The contract is concluded once the ordering process has been completed. The automatic confirmation by email confirms that your order has been received and is valid.
3. International delivery restrictions (EU & USA)
- No direct shipping: Due to strict international regulations (US customs regulations, EU Packaging Directive), we do not deliver directly to the USA or to countries within the European Union (EU).
- Swiss delivery address: Orders from the USA and EU countries will only be accepted if a delivery address within Switzerland is provided.
- Delivery to other countries: We deliver directly to all countries except the USA and the EU. The minimum order value is CHF 150.00
- Cancellation fees: If international orders have to be cancelled due to the lack of a Swiss delivery address, or if orders are cancelled by the buyer, the customer shall bear the costs of all applicable bank transfer and credit card charges, foreign exchange losses and any other costs incurred. These will be deducted from the repayment amount.
4. Shipping and Delivery Terms
- Prepayment policy: Goods will only be dispatched once full payment has been received.
- Delivery service: Items are generally dispatched via Swiss Post.
- Delivery options: You can select your preferred delivery method in the shop. Unless you explicitly choose otherwise, items are dispatched by default as an uninsured Economy parcel (without registered post).
- Postage costs: All postage costs are shown separately in the shopping basket before the purchase is finalised.
- Partial deliveries: If part of the order is unavailable, we will inform you. If you expressly request partial deliveries, the postage costs for each parcel will be charged separately.
5. Terms of Payment and Retention of Title
- Payment methods: We accept MasterCard, VISA, PostFinance and TWINT.
- Bank transfer / payment in advance: If you choose to pay by bank transfer, you will receive an invoice with a QR payment slip by email. The goods you have ordered will be reserved for you for 7 days (one week). Dispatch will take place once payment has been received.
- Retention of title: The goods delivered remain our property until full payment has been received.
6. Voluntary right of return (cancellation)
- Time limit: You may return items within 14 days of receiving your parcel without giving a reason.
- Conditions: Returns will only be accepted if the items are in their original packaging, unused, undamaged and in perfect, resalable condition.
- Return postage: Returns must be adequately stamped. The cost of returning the goods is borne by the buyer. Shipments sent carriage forward or with insufficient postage, as well as faulty, damaged or incomplete returns, will be charged to the customer. In the event of a return, the buyer shall bear all bank transfer and credit card fees incurred, as well as any associated charges. These will be deducted from the refund amount.
7. Warranty and Transport Damage
- Warranty period: All brand-new items are covered by a 2-year warranty from the date of invoicing, unless otherwise stated in the product description.
- Settlement: Warranty claims will be settled, at our discretion, by repair or replacement. The final decision on the settlement of the warranty lies with the manufacturer.
- Exclusions: The warranty claim shall lapse in the event of improper handling, normal wear and tear, lack of care, misuse or unauthorised alterations/ Attempts at repair. This entitlement is not transferable to third parties. The proof of purchase or the completed warranty certificate serves as proof of warranty.
- Damage in transit: If a delivery arrives damaged or with missing items, you must report this immediately to the carrier (Swiss Post or courier service) and have it recorded.
8. Limitation of liability
- Safety standards: In accordance with the information provided by the respective manufacturers, our products comply with the statutory safety standards for the toys industry.
- Disclaimer: As we are unable to control or monitor the proper use or play of the items, we expressly exclude all liability for damage, consequential damage or accidents arising from the use or play of the items.
- Legal framework: Liability for slight negligence, for indirect damage and for damage arising from breaches of contract by agents is excluded to the extent permitted by law (Art. 100 Abs. 1 OR).
9. Copyright, Legal Matters and Jurisdiction
- Copyright: All rights to the content of the online shop are reserved. Copyright © MODELLBAULAND Hauptwil.
- Governing law: Swiss law shall apply exclusively. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
- Jurisdiction: The exclusive place of jurisdiction for all disputes is Bischofszell, Canton of Thurgau, Switzerland (CH).
